Subject: Notice of Proposed Rulemaking, Notification of Delay of Effective Dates for "State Authorization" Regulations

On May 25, 2018, the Department published a Notice of Proposed Rulemaking (NPRM) in the Federal Register announcing the postponement, until July 1, 2020, of the effective date of the final regulations published December 19, 2016, commonly known as the “State Authorization” regulations. The NPRM also requests public comment on the delay. The deadline for submitting comments is June 11, 2018.

The regulations mainly delineate State authorization requirements for postsecondary distance education that must be met for participation in the Title IV aid programs. The Department is proposing the delay based on concerns recently raised by regulated parties and to ensure that there is adequate time to conduct negotiated rulemaking to reconsider the final regulations, and as necessary, develop revised regulations.
